General Terms and Conditions (T&Cs)

for the European Online Shop of Trendfactory GmbH

Status: October 2025

1. Scope of Application

   1. These General Terms and Conditions (hereinafter "T&Cs") apply to all orders placed by consumers residing in a member state of the European Union (EU) via the website [www.princessdolls.eu] (hereinafter "Online Shop") with Trendfactory GmbH, Neuhofstrasse 5, 8630 Rüti, Switzerland (hereinafter "Princessdolls" or "we").

   2. The contract language is German. You can retrieve, save, and print these T&Cs on the website at any time.

   3. Deviating conditions of the customer are not recognised unless Princessdolls expressly agrees to their validity in writing.

2. Conclusion of Contract

   1. The presentation of products in the Online Shop does not constitute a legally binding offer but a non-binding invitation to place an order.

   2. By clicking the "Place order with obligation to pay" button, you submit a binding offer to purchase the selected goods.

   3. Upon receipt of your order, you will immediately receive an automatic order confirmation via email. This merely confirms the receipt of your order and does not yet constitute acceptance of your offer.

   4. The purchase contract is concluded as soon as we accept your order by order confirmation (via email) or ship the goods.

3. Prices and Shipping Costs

   1. All prices are quoted in Euro (€), including shipping, excluding statutory value-added tax (VAT) and import duties in accordance with the applicable EU regulations.

   2. Shipping costs within the EU are borne by Princessdolls. There are no additional shipping costs for the customer.

   3. Import duties, customs duties, local VAT, or other governmental charges arising from the import of the goods into the destination country shall be borne by the customer. Princessdolls is neither responsible for the collection nor for the amount of such charges. Please inform yourself with your national customs authority before placing an order.

4. Delivery and Delivery Time

   1. Delivery is made via dropshipping directly from the supplier to your specified delivery address within the EU.

   2. The stated delivery times are non-binding and serve only as guidelines. Princessdolls endeavours to deliver the goods within 3–8 weeks after the conclusion of the contract. Delays due to supply bottlenecks, production times, or exceptional circumstances (e.g., force majeure) are reserved.

   3. The risk of delivery passes to the customer upon handover of the goods to the shipping service provider.

5. Payment Terms

   1. The following payment methods are available:

      • Credit Card (Visa, Mastercard) / PayPal / Sofortüberweisung (Instant Transfer) / Bank Transfer (Prepayment)
      • Availability may vary depending on the country

   2. If the Bank Transfer payment method is selected, the invoice amount must be paid within 10 days of receiving the order confirmation.

6. Retention of Title

   The ordered goods remain the property of Princessdolls until full payment of the purchase price.

7. Right of Withdrawal (for consumers only)

   1. Instructions on Withdrawal

      You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day on which you or a third party named by you (who is not the carrier) has taken possession of the last goods.

   2. Exclusion of the Right of Withdrawal

      The right of withdrawal does not apply to goods that are

      • manufactured according to customer specifications (e.g., custom-made products, individual dimensions, colour requests) or
      • delivered sealed for health protection or hygiene reasons and are no longer suitable for return after the seal has been removed.

      Since the offered products (Real Dolls) are hygiene-sensitive and can be custom-made, the purchase generally falls under these exceptions. If you order a standard version without individual customisation, a right of withdrawal may exist – this will be checked on a case-by-case basis for unopened deliveries.

   3. Return in case of justified withdrawal

      In the event of an effective withdrawal, the services received must be returned. You bear the direct costs of the return. The goods must be unused, in their original packaging, and hygienically intact.

8. Warranty and Notice of Defects

   1. Princessdolls delivers goods to the best of its knowledge and belief. Minor deviations in colour, texture, or dimensions due to the manufacturing process do not constitute defects.

   2. Defects must be reported immediately, but no later than within 14 days of receipt of the goods in writing (email suffices).

   3. In the event of a justified notice of defect, Princessdolls is entitled to provide subsequent performance by repair or replacement delivery. If the subsequent performance fails, you are entitled to statutory rights (reduction in price, withdrawal).

   4. The warranty does not apply in cases of: improper handling, natural wear and tear, unauthorised repairs or modifications, transport damage (unless reported to the delivery person), or use outside the intended purpose.

9. Liability

   1. Princessdolls is liable without restriction for damages resulting from intent or gross negligence, as well as for damages resulting from injury to life, body, or health.

   2. In all other respects, liability – as far as legally permissible – is limited to contract-typical, foreseeable damages.

   3. Princessdolls is not liable for damages resulting from improper use, public display, passing on to third parties, or lack of hygiene.

   4. Princessdolls assumes no responsibility for links to external websites. The content of third-party pages is explicitly not adopted as our own.

10. Data Protection

    Your personal data will be processed exclusively within the framework of the applicable data protection laws (in particular the GDPR). Further information can be found in our Privacy Policy on the website.

11. Cancellation and Annulment

    1. Customer-specific orders (custom-made products) cannot be cancelled.

    2. If a standard order is cancelled before shipment, cancellation fees amounting to 33% of the order value, but at least €120, will be incurred.

    3. Unpaid down payments or payments are considered a withdrawal from the contract and trigger the aforementioned cancellation fees.

12. Final Provisions

    1. Applicable Law: The law of the Swiss Confederation applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This also applies to orders from abroad or deliveries abroad.

    2. Place of Jurisdiction: The place of jurisdiction for all disputes arising from or in connection with this contract is Zurich, Switzerland, as far as legally permissible. Consumers residing in the EU can alternatively appeal to the courts of their country of residence.

    3. Severability Clause: Should any provision of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.
